Article 1 General provisions - Application of the GTC
These general terms and conditions of sale apply, without restriction or reservation, to all sales concluded by Arthur's Cellar with buyers wishing to purchase products offered for sale on the website www.arthurscellar.com.
Confirmation of the order implies full acceptance of these GTC by the customer.
In the absence of any other written agreement between the seller and the customer, these GTC shall prevail. Except in special cases, there is therefore no handwritten signature of this document to conclude a sale; confirmation of the order by the customer constitutes approval of the content of the GTC.
In the event of any changes to the GTC, those visible on the website on the date the order is placed shall apply.
These GTC are governed by and subject to Swiss law.
The products presented on the Arthur's Cellar website are offered for sale in Switzerland.
The photos and illustrations are not contractual. The information and explanations are provided for informational purposes only. They do not constitute a contractual document.
Our offers are exclusively reserved for customers who are of legal age and capable (this implies not being under guardianship or trusteeship).
In accordance with Article 13681 of the Swiss Criminal Code, the sale of spirits, aperitifs, and alcopops in quantities that could endanger health is prohibited to persons under the age of eighteen (18). The sale of wine, cider, and beer is prohibited to persons under the age of sixteen (16). The buyer undertakes to certify that they are of the minimum legal age required.
Alcohol abuse is dangerous for your health. Please consume and enjoy in moderation.
With the exception of professional buyers, the resale for commercial purposes of items purchased on the Arthur's Cellar website is prohibited. Professional customers must make themselves known to Arthur's Cellar. An additional payment period may be granted to them within the legal limits. This period is indicated on the quote submitted for prior acceptance by the professional. The quote is valid for thirty (30) days from the date of issue. Acceptance of the quote and the order constitutes acceptance of these GTC.
The order will be prepared upon receipt of the quote signed by the professional customer, provided that all the information necessary for the preparation of the order has been provided to Arthur's Cellar.
Late payment penalties are payable from the day following the payment date shown on the invoice.
Article 2 Order confirmation - payment terms
Orders are only final and prepared after receipt of payment and full contact details for the purchaser and recipient of the order. Order preparation is subject to receipt of all these details. If any details are missing, Arthur’s Cellar cannot be held responsible for any delay in delivery.
Credit card payments are secured using the Saferpay system. Arthur's Cellar does not store any of the bank details provided during online purchases. These details are of course not visible online.
The full amount of the order must be paid upon confirmation of the order by the customer prior to delivery.
Arthur's Cellar reserves the right to refuse to fulfill an order for a customer with whom an ongoing dispute has not been resolved.
Arthur's Cellar issues an invoice. It remains available on the website under the “My Account” section. A copy is also sent to the customer by email with the order confirmation.
The wines remain the property of Arthur's Cellar until the invoice has been paid in full. This right of ownership is valid until the order has been paid for in full. It allows Arthur's Cellar to take back possession of the products concerned, if necessary.
Our offers are subject to availability. Product availability is confirmed on the website at the time of order confirmation. In the event that a purchased product was listed as in stock when it was actually out of stock, Arthur's Cellar will contact you within 48 hours to offer you a replacement vintage or arrange a refund.
Article 3 Prices
Prices are quoted in Swiss francs (CHF). They include VAT.
For business accounts, prices will be displayed excluding tax once you have logged into your account. The payment deadline depends on the terms and conditions of sale applicable to you.
The price indicated for each product does not include delivery or insurance costs.
Shipping costs are calculated based on the number of bottles ordered and the destination. When the customer specifies the delivery location, the corresponding rates are indicated.
The order confirmation shows the total amount due, including all taxes, shipping, handling, and administrative costs. This price is final.
Arthur's Cellar reserves the right to modify its prices at any time. The applicable prices are those in effect on the website on the date and at the time of order confirmation, subject to correction of obvious errors and typos. Damages in the event of obvious errors and/or typos are excluded.
Article 4 Delivery
Upon receipt of payment and confirmation of the order, Arthur's Cellar will prepare your package. Delivery will be made to the address indicated on the order form. The buyer must ensure that the contact details provided are accurate. Arthur's Cellar cannot be held responsible for delivery problems in the event of errors or incomplete information in the address on the order form. If the goods are returned due to an incorrect or incomplete address, the customer may choose between a new shipment, for which they will bear the full cost, or a refund of the order after deduction of shipping costs.
Unless otherwise agreed in writing, orders are delivered in a single shipment. Delivery is considered complete upon delivery of the products to the customer. The buyer's signature serves as proof of delivery.
Within 30 days of the presumed delivery date, unless the buyer has made a phone call or sent an email reporting a problem with the order to be received, Arthur's Cellar considers the delivery to have been made. The buyer can then no longer make a claim for non-receipt.
Goods are transported at the buyer's risk. Arthur's Cellar cannot be held responsible for any deficiencies in the postal or transport service.
Any complaints about the quality of the delivery service must be sent by email or telephone to Arthur's Cellar within 72 hours.
It is the buyer's responsibility to check the condition of the goods upon delivery and to note any reservations on the delivery slip if they notice any missing items, breakages, or damage. The buyer must also confirm these reservations by sending a registered letter with acknowledgment of receipt to Arthur's Cellar within 48 hours of receiving the goods.
For deliveries outside Switzerland, it is necessary to contact us by email or telephone.
If the customer refuses to accept the order, it will be returned to Arthur's Cellar at the customer's expense.
Article 5 Delivery times
Arthur’s Cellar undertakes to make every effort to ensure that orders are delivered as quickly as possible.
Deliveries are not made on Saturdays, Sundays, or national and cantonal holidays.
The order summary specifies the delivery deadline. If this deadline is exceeded by more than 10 days, without justification due to force majeure, the buyer may request cancellation of the sale and reimbursement of all costs incurred.
In the case of an order with different delivery times for different products, the longest delivery time will be used as the reference for the entire order. If one of the products is unavailable, Arthur's Cellar may deliver in several stages.
If delivery cannot be made within the specified time frame, the customer will be notified by Arthur's Cellar. The customer may then cancel their order and obtain a full refund. They may request an exchange or a full refund.
Delivery times run from the date of receipt of payment and confirmation of the order.
If the delivery address has been provided incorrectly, the buyer shall bear the consequences (delayed delivery, additional shipping costs).
Article 6 Shipping legislation
Orders are subject to Swiss law.
Internet users placing orders on the Arthur's Cellar website undertake to comply with Article 13681 of the Swiss Criminal Code on the sale of alcohol, which stipulates that the sale of spirits, aperitifs, and alcopops is prohibited to persons under the age of eighteen (18) and that the sale of wine, cider, and beer is prohibited for persons under the age of sixteen (16). Buyers therefore agree to be of legal age to place an order and not to be under any protective measures such as guardianship or curatorship.
For any order destined for a country other than Switzerland, the customer must contact Arthur's Cellar before placing the order to inquire about international delivery options.
Arthur's Cellar reserves the right to cancel an order if it is to be delivered to a country where the importation of alcohol or wine is prohibited by law.
Orders for export are subject to the legislation of the destination country.
Article 7 Stock depletion
All wines sold by Arthur's Cellar are stored on our premises. Stock is therefore managed directly, without intermediaries. Products are offered for sale until stocks are depleted.
If, during order preparation, products are damaged or destroyed and are therefore out of stock, Arthur's Cellar will offer a vintage of equivalent or superior quality and value.
Arthur's Cellar undertakes to communicate any such unforeseen circumstances as soon as possible and to make every effort to provide an equivalent solution. The buyer may request partial or total cancellation of the sale if the replacement products are not to their satisfaction. They waive any claim for damages.
Article 8 Returns, corked bottles, defects
No returns/exchanges/refunds are possible, and defects or delivery errors must be reported in accordance with our terms and conditions set out below.
All requests will be handled individually with care and attention. Arthur's Cellar International SA makes every effort to ensure that the wines in its possession are stored and preserved in good conditions, but cannot be held responsible for the state or condition of these wines, nor for the quality that might be expected based on their description. In accordance with the provisions of the Swiss Wine Trade Association, defective bottles will only be replaced if the Swiss or foreign wines are bottled in Switzerland, and within one year of purchase. Foreign wines bottled in the country of production or elsewhere will not be replaced or credited. Arthur's Cellar International SA must be notified of any defect or irregularity within a maximum of 8 days after collection or receipt of the goods.
Arthur's Cellar International SA cannot be held liable for defects in goods, its obligations being limited to the right of replacement. Arthur's Cellar International SA's liability for any other shortcomings is limited to damage caused by intentional misconduct and gross negligence.
In all cases, the customer must inform Arthur's Cellar in writing (email, fax, letter) of their decision before returning goods that do not comply with the order, in order to ensure optimal follow-up.
Products must be returned in their original packaging, in good condition and accompanied by the invoice.
Any product that has been consumed in whole or in part will be deducted from the refund amount.
Article 9 Limitation of liability and warranty
Except as provided in Article 8, our products are covered by a warranty against any hidden defects that render them unfit for consumption, within 30 days of sale. To this end, the product(s) must be returned to us in their original packaging and condition.
In the event of misuse, improper storage, or negligence on the part of the buyer, the warranty does not apply. Arthur's Cellar may request an appraisal of the wines involved in the dispute.
Rare wines and vintages over 15 years old are not covered by the warranty, as they are offered for sale based solely on their reputation.
Article 10 Non-contractual photos
The photos are illustrations for information purposes only and have no contractual value. Photo credits are mentioned under each photo or, if not mentioned, are the property of Arthur’s Cellar.
Article 11 Disputes
These terms and conditions of sale are subject to Swiss law. Any dispute shall be governed exclusively by Swiss law. The place of jurisdiction is determined by the law on places of jurisdiction. It is located in the canton where www.arthurscellar.com has its registered office, namely the canton of Geneva.
In the event of a dispute, the buyer must first contact Arthur's Cellar to agree on an amicable solution.
